Texas AG files suit to stop trans women’s participation in college athletics

Texas Attorney General Ken Paxton has filed a lawsuit against the National Collegiate Athletics Association (NCAA) to try to prevent transgender women from competing in women’s college sports, according to NBC Dallas/Fort Worth.

Paxton alleged in his complaint that the NCAA is violating the Texas Deceptive Trade Practices Act by marketing sporting events as women’s but allowing “mixed sex competitions” in which “biological males compete against biological females.” He argues that transgender women competing in women’s sports is “inherently unfair and unsafe” because of “physiological advantages.”

He also stated that “Consumers purchase goods and services associated with women’s college sports because they enjoy watching women compete against women—not men competing against women. Consumers make these purchases to support female empowerment and fair competition among women. The impact of women’s sports on the self-esteem, academic achievement, future employment, and development of women and girls is profound and enduring.”

Paxton wants the court to grant a permanent injunction to ban transgender women from competing in women’s sporting events in Texas or to cease marketing events as women’s sports.

“College sports are the premier stage for women’s sports in America,” NCAA Director of Communications Michelle Brutlag Hosick said in a statement. “While the NCAA does not comment on pending litigation, the Association and its members will continue to promote Title IX, make unprecedented investments in women’s sports and ensure fair competition in all NCAA championships,” according to KVUE.

There is no instance of a transgender athlete competing in the state.
